The United States, along with several countries throughout the world, is working actively to make international travel easier for everyone. This includes reducing the amount of documentation needed and streamlining the application process without jeopardizing security in the process.

To this end, dozens of countries are now involved in the visa waiver program (VWP), a system that makes it easier to get into a country - and bypassing typical visa requirements.

Though the system is designed to be simple and user-friendly, you will only qualify through the electronic system for travel authorization (ESTA) if you meet certain requirements. For starters, you will only be allowed to travel to the United States if you're traveling for tourism or business purposes.

But is traveling for business always enough to guarantee your entry into the United States? Are therecertain types of business activities that are prohibited?

What Is the Visa Waiver Program (VWP)?

Let's start with a basic explanation of how the VWP works. The VWP is designed for countries that are developed and on friendly terms with one another. Traditionally, travelers are required to secure a visa with their destination country before initiating travel; they also need to have an international passport from their home country.

While the passport is always going to be required, citizens of countries in the VWP may be able to bypass the visa requirement by filling out a short form online and answering a handful of important questions. This process is meant to evaluate risk and analyze the traveler, putting them on the fast track for entry into the country.

VWP Travel Requirements

To qualify for entry into a country within the VWP, you'll need to meet a handful of important requirements.

  • Origin. The VWP extends to many countries - but not all of them. Be sure to review the list ofeligible countries under the VWP. If you're coming from a country outside this list, you'll need to secure a visa no matter what.
  • Purpose. Only certain types of travel will qualify under the VWP. Tourism travel, including visiting landmarks, spending time with relatives, and even getting medical treatment, is permitted. Business travel is also permitted, but as you'll see, not all types of business activities qualify under this program.
  • Duration. To qualify for an ESTA, you must be in the United States for less than 90 days.

Permitted Business Activities

For the most part, any activity you do for business purposes will be allowable under the VWP, as long as you're not receiving compensation from a U.S. company.

For example:

  • Consulting. If you're providing consulting services for another entity, or if you're the recipient of consulting services in the U.S., you should have no trouble qualifying to travel under the VWP.
  • Attending a conference. You're also allowed to attend a conference or other industry event in the United States through the VWP. However, you should note that you're not allowed to receive any pay from a U.S.-source, aside from compensation for the expenses you incur during your trip.
  • Attending short-term training. You can attend short-term training and education opportunities in the United States as part of your professional development. The compensation requirements apply here, too; you must not receive pay from a U.S. source, other than basic compensation for your personal expenses.
  • Negotiations. You can qualify for travel to the United States if you're attending a negotiation as well.
  • Observation. Business travelers can be permitted to travel for observation.
  • Professional sports and entertainment. Professional athletes and entertainers may also qualify, as long as their compensation comes from a foreign entity.

There are also some specific regulations related to certain industries and business activities. For example, if you're seeking investment in the United States and your activities are considered productive labor, you'llneed an E-2 visa - which means you won't qualify for an ESTA. If you want to establish a new location for your business, or an entirely new branch of your company, you won't qualify; you'll need an L-1 visa to do this.

Some business situations are ambiguous; for example, you should be allowed to provide services on a private yacht, but you'll need to meet several conditions to do this. Be sure to do your research to make sure your specific intended activities are permitted.

As long as your intended business activities fall into these permitted categories, you should have no trouble being authorized for travel. However, keep in mind that you also need to remain compliant with the other requirements of the VWP and ESTA. If you're flagged as a security risk, if your identification doesn't check out, or if you don't provide satisfactory answers to the qualifying questions, your ESTA application may still be rejected.
