Oakland County Criminal Defense Lawyer Paul J. Tafelski Explains Michigan’s Romeo and Juliet Law

Oakland County criminal defense lawyer Paul J. Tafelski release a new article (https://www.michigandefenselaw.com/criminal-sexual-conduct.html) explaining Michigan’s Romeo and Juliet Law. The lawyer mentions that when sex occurs without consent, it is a sex crime. These offenses are charged as misdemeanors or felonies, depending on the nature of the individual offense.

According to the Oakland County criminal defense lawyer, “Many states have “Romeo and Juliet” laws that permit consensual sex between adolescents and slightly older, yet legally adult, peers. These laws exist in acknowledgment that when there is an age gap in a relationship between two teenagers, the couple can reach a point where their relationship becomes illegal simply due to the older partner’s 18th birthday.”

The lawyer further explains that Michigan enacted its Romeo and Juliet Law in 2011. This law states that an individual under the age of 18 who is found guilty of engaging in consensual sex with a partner no more than four years his or her junior can petition to the court to avoid having to register as a sex offender. Any individual who has sexual relations with a person under 16 can still face criminal penalties.

Attorney Paul J. Tafelski adds that being four years within the victim’s age does not necessarily mean that the offender will have to register as a sex offender. They may petition to be kept off the sex offender registry. The court can consider a variety of factors, such as the parties’ ages, maturity levels, and the nature of the offense in order to determine whether to approve the petition.

“The penalties an individual faces for a sex crime conviction depend on the nature of his or her charge and the presence of any aggravating or mitigating factors. For example, sexual conduct with a child under the age of 13 is charged as first-degree criminal sexual conduct, whereas sexual conduct with a child between 13 and 16 is charged as second-degree criminal conduct,” says the defense lawyer.

Lastly, attorney Paul Tafelski encourages those who are charged with a criminal offense to seek the help of an experienced criminal defense attorney. Having a skilled lawyer may be able to help the defendant protect their freedom and understand their rights in the case.
