Lawsuit says pilfered, private data now in the public record
The former president of Dallas-based Future Infrastructure LLC has filed a lawsuit against the current president of communications of the telecom equipment installer, alleging that his private and confidential information was unlawfully accessed during an alleged investigation.
In the lawsuit filed in state district court in Dallas, Ricky Riggs claims his privacy rights were violated when Future Infrastructure’s Scott Comley improperly clicked on private links to view, access and download protected information from Riggs’ attorney.
Riggs’ lawsuit alleges that the information, available only through online third-party portals outside of the company’s server, was then used as a basis to fire Riggs and file a lawsuit against him. That lawsuit was filed by Future Infrastructure and its parent company, Primoris Services Corporation, despite Riggs being unaware that confidential information from his attorney had been accessed and attached to the complaint, putting the material into the public record.

This is about an employer actively and aggressively invading the private communications of an employee and his attorney and using that information against him. This case will determine critically important issues covering the basic privacy rights of employees in Texas and beyond.”
According to the lawsuit, accessing private information in this instance is equivalent to an employer using personal health care or financial information to fire an employee. None of the documents was attached to any email sent by Riggs or his attorney, and none of the privileged information in the documents was ever displayed in any of the emails.
The case is Riggs v. Comley, Case No. DC-25-05746 in the 193rd District Court in Dallas County.
