Viamedia Welcomes the Court’s Decision that Its Longstanding Antitrust Case Against Comcast Should Proceed to Trial on October 5, 2026

Viamedia’s long-running antitrust case against Comcast will proceed to trial before a jury in Chicago. Judge Sharon Johnson Coleman of the United States District Court for the Northern District of Illinois denied Comcast’s motion for summary judgment on October 14, 2025. That decision, initially issued under seal, became public last week. Viamedia, Inc. v. Comcast Corp., No. 1:16-cv-05486, Dkt. 758 (N.D. Ill. Oct. 14, 2025). Today, the Court set a trial date for October 5, 2026. The Court’s decision to proceed to trial is consistent with the Seventh Circuit’s decision in 2020 as well as the U.S. Department of Justice’s recommendation to the U.S. Supreme Court which denied Comcast’s petition for certiorari in 2021.

The Court’s ruling allows Viamedia to present its case in full at trial. The Court rejected Comcast’s attacks on Viamedia’s legal theories, excluded certain of Comcast’s expert’s opinions, and allowed Viamedia’s experts to testify on all of their opinions. Viamedia seeks injunctive relief requiring Comcast to give fair and open Interconnect access to Viamedia and its clients. Viamedia also seeks damages “totaling $303.2 million to $387.3 million in damages” (quotes from the Court opinion).
