Court Sides with Plaintiff on Numerous Discovery Motions Regarding Third-Party Deaths in Custody

Chicago, IL - July 27th, 2023 - In a series of recent rulings, a district court in the Southern District of Illinois concluded that Wexford Health Sources, Inc. (Wexford) and the Illinois Department of Corrections (IDOC):

(1) Cannot withhold documents assessing prisoner care under the Illinois Medical Studies Act,

(2) Cannot redact documents related to contracts with the state and/or defendant compensation for "relevance",

(3) Must produce documents and emails related to more than 50 prisoners who died under circumstances similar to Craigory Green, the decedent.

Additionally, the Court ruled that (4) Wexford cannot "withdraw" from production a memorandum discussing Wexford and IDOC's responses to allegations that they provide prisoners with care that does not meet constitutional requirements.

This is a significant win for Plaintiff Victoria Green, a client of the prisoners’ right attorneys at Kaplan & Grady, who is fighting for justice on behalf of her nephew, Craigory Green, who needlessly died in custody at just 30 years old, while Wexford Health Sources, Inc. and Illinois Department of Corrections Defendants debated who would be responsible for his care.
