The new report covers giving by-law notice of contravention as required under the Body Corporate and Community Management Act of 1997. The report also details when the body corporate should give a continuing contravention notice and a future contravention notice.
Instructions are also given if an occupier fails to comply with a contravention notice and the subsequent fines that can be imposed by the Magistrates court for non compliance. The report also explains how an owner or occupier can take steps to enforce by-laws being breached.
This post outlines a step-by-step process of drafting a Contravention Notice detailing the alleged breach to be sent to the person believed to have caused the breach and the repercussions the said individual will face if they fail to comply with the notice.
