Item 8.01. Other Events

On December 24, 2008, Dole filed an application with the Court of First Instance of the European Communities requesting it to annul the European Commission Decision of October 15, 2008 finding that Dole infringed Article 81 of the EC Treaty and imposing a fine on Dole of €45.6 million.
